Welcome to Swizil - Worth sharing!

These Terms of Service ("Terms") govern your access to and use of the Swizil mobile application and related services (collectively, "Swizil," the "Service," "we," "our," or "us"). By downloading, installing, registering, or using Swizil, you agree to be legally bound by these Terms and our Privacy Policy and to receive automatic app and service updates that may be necessary for security, operability, or feature changes, some of which may install irrespective of user settings where required to address critical issues. If you do not agree, you must not use the Service.

User Eligibility

You must be at least 13 years old to use Swizil, and if you are a minor in your jurisdiction you affirm and represent that you have obtained appropriate parental or legal guardian consent to use the Service and accept these Terms. You also confirm that any information you provide during account creation or use of the Service is accurate, current, and complete.

User Account

You are responsible for maintaining the confidentiality of your Swizil account credentials and for any activity under your account. You agree to notify us immediately if you suspect any unauthorised use. Each individual is permitted to maintain only one account. Duplicate, impersonated, or fraudulent accounts are strictly prohibited.

Content Ownership and Licensing

By uploading or submitting content through Swizil, you retain full ownership of your content. However, you grant Swizil a worldwide, non-exclusive, revocable, royalty-free, licence to use, host, store, process, reproduce, and technically adapt (including to cache, compress, transcode, and reformat) and display your content solely for the purposes of operating, providing, and improving the Service and features you choose to use. Any public display or distribution occurs only when you explicitly choose to share or make content visible to others through your settings (including your directed sharing to thirdparty platforms). We may sublicense this licence only to our service providers to the extent necessary to deliver the Service. This licence continues for as long as your content remains on the platform, unless otherwise removed by you or your account is deleted subject to limited retention in backups or where required by law. You waive any moral rights in relation to the content, to the extent permitted by applicable law.

You confirm that you have all necessary rights, licences, and consents to upload and share the content, and that such content does not infringe any rights of third parties. Swizil may use anonymised content and behavioural data to improve the Service, including for the training and enhancement of AI features. Such use excludes personal identifiers unless you provide explicit consent. Deleted content may remain in system backups for a limited time or where required by law.

Third-Party Integrations

Swizil integrates with third-party services such as Meta (including Facebook, Instagram, WhatsApp, and Messenger), TikTok, YouTube, LinkedIn, and X (formerly Twitter). When you connect your Swizil account with these platforms, you authorise us to access certain minimum and necessary information—such as your public profile, media, content metadata, and user identifiers—in line with each platform's terms and policies. You may revoke access at any time via your account settings on the connected platform. Access to external services and integrations may be changed, suspended, removed, disabled, or limited at any time without notice or liability, and access to thirdparty content may become unavailable where rights change or those platforms restrict availability, in which case notice may be given when possible.

Swizil disclaims any responsibility for how third-party platforms manage or use your data once accessed. You are solely responsible for complying with the terms and privacy policies of those platforms, including any age, content, and usage rules applicable to your accounts on those platforms. If a thirdparty platform disables or limits your account or changes its policies, related Swizil features may stop working or be removed.

Additionally, we work with trusted third-party vendors and sub-processors for hosting, analytics, payments, moderation, and other core services. We assess these partners for compliance and data protection standards. A list of current sub-processors is available at swizil.com/sub-processors.

Photo and Media Access

When you grant permission, Swizil may access your device’s photo library or storage to retrieve, cache, and process selected media for content creation. Media may be used, in anonymised form, to enhance features such as image recognition, caption generation, and curation tools. This access may be revoked at any time via your device or app settings.

Swizil’s automated tools (e.g. batch captioning or uploads) are subject to reasonable use limitations. Abusive or excessive automated usage may result in temporary or permanent restrictions.

Payments and Subscriptions

Certain features of Swizil may require payment, including one-time purchases or recurring subscriptions. All purchases initiated in the app are securely billed and processed by the third-party payment gateways such as Apple App Store or Google Pay and applicable pricing, billing terms, and refund policies are clearly outlined within the App.

Subscriptions renew automatically unless cancelled prior to the end of the billing cycle. You will be charged before the start of each period and cancellations take effect at the next period. Swizil cannot issue refunds directly for store processed transactions.

Billing, cancellations, and refunds for purchases made through Apple or Google are handled by the applicable store and governed by their terms and refund policies, including any statutory right of withdrawal (for example, a 14day withdrawal right in the EEA and UK for certain digital purchases) and exceptions where delivery has begun at your request. Swizil does not process storepurchases refunds directly except where required by law.

Acceptable Use Policy

You agree not to misuse Swizil or engage in any of the following prohibited activities:

  • Posting hateful, violent, defamatory, or discriminatory content

  • Harassing, threatening, or bullying individuals or groups

  • Uploading sexually explicit, exploitative, or non-consensual imagery

  • Impersonating others or misrepresenting your identity

  • Sharing misleading, manipulated, or harmful misinformation

  • Violating intellectual property or privacy rights

  • Using unauthorised bots, scrapers, or automation

  • Attempting to disrupt, overload, or compromise the Service

Swizil may label or remove content that violates this policy and may suspend or terminate your account at our discretion.

Intellectual Property

Subject to these Terms, Swizil grants you a limited, personal, nontransferable, nonsublicensable licence to install and use the app and access the Service for your personal, noncommercial use on devices you own or control, as permitted by applicable platform usage rules.

All intellectual property rights in and to Swizil, including but not limited to the software code, application design, visual layout, user interface elements, database structures, underlying algorithms, trademarks, logos, trade dress, documentation, and all other content or materials provided as part of the Service are and shall remain the exclusive property of Swizil Ltd or its licensors. These materials are protected by applicable intellectual property laws including copyright, trademark, and trade secret laws.

Except as expressly permitted in these Terms or by Swizil Ltd in writing, and subject to applicable platform usage rules, you must not: (i) distribute or make the app available over a network where it could be used by multiple devices at the same time; (ii) rent, lease, lend, sell, redistribute or sublicense the app; or (iii) copy (except as permitted by this licence and usage rules), reverseengineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the app, its updates, or any part of it, except to the extent any foregoing restriction is prohibited by applicable law or permitted by opensource licence terms governing included components. Any unauthorised use constitutes a violation of these Terms and may result in legal action.

Disclaimers and Limitations

Swizil is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted operation, availability, or fitness for a particular purpose. Swizil is not responsible for any user-generated content, nor do we moderate all activity on the platform.

To the maximum extent permitted by law, Swizil Ltd disclaims liability for indirect, incidental, consequential, or special damages, including loss of profit, data, or goodwill. If found liable, our cumulative liability to you will not exceed the amount paid to us in the preceding 12 months, or £0 for free users.

Termination

Swizil may suspend, modify or discontinue any feature or the Service in whole or in part, suspend or terminate your access, where reasonably necessary for operational, security legal, or rights-management reasons, or if you breach these Terms or applicable laws, compromise platform integrity, or engage in harmful conduct. Where reasonably possible, Swizil will provide prior notice, but may act without notice to protect users, comply with law, or address security, abuse, or rights issues. Upon termination, your rights under these Terms will end immediately.

You may delete your account at any time. Some residual data may be retained as necessary for legal compliance, dispute resolution, or backup purposes, as described in our Privacy Policy

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England.

Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page, and the "Last Updated" date will be revised. For any material changes, we will provide at least 30 days’ prior notice before they take effect. Your continued use of the Service after the notice period where relevant, or changes, are posted, constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.

Data Privacy and AI Transparency

Swizil is committed to transparency in how we process your personal data. We comply with all applicable data protection laws and process personal information on legal bases including user consent, contract necessity, and legitimate interest.

Swizil may use anonymised user data to improve the Service, including automated tools that enhance features like content moderation and captioning. Where required, we seek explicit consent before processing identifiable information.

In the event of a data breach affecting your personal information, Swizil will notify you and any relevant authorities in accordance with applicable legal obligations.
